The <a target=\"_blank\" href=\"https:\/\/www.reuters.com\/business\/autos-transportation\/chinese-ev-makers-file-challenges-tariffs-eu-court-2025-01-23\/\" style=\"\" rel=\"noopener\">Chinese firms<\/a> and <a target=\"_blank\" href=\"https:\/\/www.reuters.com\/business\/autos-transportation\/bmw-joins-chinese-ev-makers-filing-eu-court-challenge-tariffs-2025-01-24\/\" style=\"\" rel=\"noopener\">BMW<\/a> registered their complaints at the General Court \u2014 the lower of two CJEU chambers \u2014 last week. Proceedings at the General Court last an average of 18 months and can be appealed. <\/p>\n<p style=\"padding:0;margin:0;line-height:1.15;orphans:2;widows:2;text-align:left\"><strong>The tariffs: <\/strong>The EU imposed <a target=\"_blank\" href=\"https:\/\/enterprise.news\/logistics\/en\/news\/story\/547ccdae-a0b4-4a26-a0ad-ad7c2b15ff9b\" style=\"\" rel=\"noopener\">extra tariffs<\/a> in October, ranging from 7.8% for Tesla to 35.3% for China\u2019s SAIC. BMW was hit with a 20.7% increase due to its electric Mini Cooper and Mini Aceman models being made in China, <a target=\"_blank\" href=\"https:\/\/www.bloomberg.com\/news\/articles\/2025-01-27\/tesla-bmw-sue-eu-after-china-made-evs-are-hit-by-trade-curbs\" style=\"\" rel=\"noopener\">Bloomberg<\/a> reports.<\/p>\n<p style=\"padding:0;margin:0;line-height:1.15;orphans:2;widows:2;text-align:left\"><strong>What will the challenges address? <\/strong>The challenges will probably involve disputes over subsidy assessments, determining the harm to EU industry, and the Commission's uncommon choice to initiate a case independently rather than in response to an industry complaint, <a target=\"_blank\" href=\"https:\/\/www.reuters.com\/business\/autos-transportation\/chinese-ev-makers-file-challenges-tariffs-eu-court-2025-01-23\/\" style=\"\" rel=\"noopener\">Reuters<\/a> reported last week. <\/p>\n<p style=\"padding:0;margin:0;line-height:1.15;orphans:2;widows:2;text-align:left\"><strong>REFRESHER- <\/strong>The EU increased tariffs on Chinese-built EVs by <a target=\"_blank\" href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_24_5589\" style=\"\" rel=\"noopener\">up to 45.3%<\/a> following the conclusion of its anti-subsidy probe <a target=\"_blank\" href=\"https:\/\/enterprise.news\/logistics\/en\/news\/story\/917f1b4f-e7cf-47aa-a1db-d65e6ed19793\" style=\"\" rel=\"noopener\">back in October<\/a>. The tariffs are intended to counter what the EU says are unfair Chinese subsidies for EV makers, including preferential financing and grants at below-market prices. Chinese EV brands make up some 8% of the EU market, up from less than 1% in 2019, and could reach 15% by 2025.
