{"id":69803,"date":"2023-03-23T00:00:00","date_gmt":"2023-03-23T00:00:00","guid":{"rendered":"https:\/\/enterpriseam.com\/logistics\/2023\/03\/23\/agility-will-get-usd-1-65-bn-in-settlement-money-from-iraqs-korek-telecom-and-sirwan-barzani\/"},"modified":"2023-03-23T00:00:00","modified_gmt":"2023-03-23T00:00:00","slug":"agility-will-get-usd-1-65-bn-in-settlement-money-from-iraqs-korek-telecom-and-sirwan-barzani","status":"publish","type":"post","link":"https:\/\/enterpriseam.com\/logistics\/2023\/03\/23\/agility-will-get-usd-1-65-bn-in-settlement-money-from-iraqs-korek-telecom-and-sirwan-barzani\/","title":{"rendered":"Agility will get USD 1.65 bn in settlement money from Iraq\u2019s Korek Telecom and Sirwan Barzani"},"content":{"rendered":"<p style=\"padding:0;margin:0;line-height:1.15;orphans:2;widows:2;text-align:left\"><span style=\"\"><\/span><span style=\"font-weight:700\">A subsidiary of Kuwait\u2019s Agility and an affiliate were awarded USD 1.65 bn in<\/span><span style=\"font-weight:700\"> damages and legal expenses <\/span><span>after a tribunal determined that their USD 810 mn investment in Korek Telecom was expropriated illegally, according to a company <\/span><span style=\"text-decoration-skip-ink:none;-webkit-text-decoration-skip:none;\"><a href=\"https:\/\/www.agility.com\/en\/investor-relations-news\/agility-announces-arbitration-decision-in-korek-case\/\" style=\"\">statement<\/a><\/span><span>.<\/span><span>The International Chamber of Commerce Arbitration\u2019s decision will see<\/span><span style=\"font-weight:400;\">Korek Telecom and its controlling shareholder, Iraqi businessman Sirwan Barzani, pay out the compensation to Agility\u2019s Iraqi subsidiary Iraq Telecom (IT), and its affiliate, International Holdings (IH). <\/span><\/p>\n<p style=\"padding:0;margin:0;line-height:1.15;orphans:2;widows:2;text-align:left\"><span style=\"font-weight:700\">The breakdown:<\/span><span style=\"font-weight:400;\"> IH will be getting USD 1.329 bn, while USD 318.7 mn will go to IT.  <\/span><\/p>\n<p style=\"padding:0;margin:0;line-height:1.15;orphans:2;widows:2;text-align:left\"><span style=\"font-weight:700\">What happened?<\/span><span> The original <\/span><span style=\"text-decoration-skip-ink:none;-webkit-text-decoration-skip:none;\"><a href=\"https:\/\/www.reuters.com\/article\/pws-orange-korek-idUSL8N1QW3WG\" style=\"\">claim<\/a><\/span><span> was <\/span><span>filed by Kuwait's Agility and France\u2019s Orange with the Dubai-based tribunal in March 2018. It accused Korek Telecom and Barzani of bribing and corrupting Iraqi regulators in order to reach a wrongful decision of expropriating Agility\u2019s subsidiary and affiliate\u2019s holdings in Korek Telecom. <\/span><span style=\"font-weight:400;\">The Tribunal agreed to this, and to the claim that Barzani had \u201cbreached his fiduciary obligations by engaging in multiple acts of self-dealing and misconduct, causing harm to the claimants,\u201d according to the statement.<\/span><\/p>\n<p style=\"padding:0;margin:0;line-height:1.15;orphans:2;widows:2;text-align:left\"><span style=\"font-weight:700\">Background:<\/span><span> A <\/span><span style=\"text-decoration-skip-ink:none;-webkit-text-decoration-skip:none;\"><a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2019-05-22\/orange-pushed-from-iraq-as-regulator-seizes-stake-in-mobile-unit\" style=\"\">ruling<\/a><\/span><span style=\"font-weight:400;\">by Iraqi regulators in March 2019 had stripped Kuwait\u2019s Agility and France\u2019s Orange of their 44% stake in Korek Telecom which they had held since 2011, and diverted the stake to a group of
