{"id":82582,"date":"2023-12-06T00:00:00","date_gmt":"2023-12-06T00:00:00","guid":{"rendered":"https:\/\/enterpriseam.com\/ksa\/2023\/12\/06\/protecting-investors-if-a-financial-services-company-goes-belly-up\/"},"modified":"2023-12-06T00:00:00","modified_gmt":"2023-12-06T00:00:00","slug":"protecting-investors-if-a-financial-services-company-goes-belly-up","status":"publish","type":"post","link":"https:\/\/enterpriseam.com\/ksa\/2023\/12\/06\/protecting-investors-if-a-financial-services-company-goes-belly-up\/","title":{"rendered":"Protecting investors if a financial services company goes belly-up"},"content":{"rendered":"<p style=\"padding:0;margin:0;line-height:1.15;orphans:2;widows:2;text-align:left\"> <strong>New regulations give the regulator more leeway to protect investors if a financial <\/strong><strong>services company goes bankrupt or files for liquidation. <\/strong>A financial services company that wants to file for bankruptcy or liquidation will need to follow new rules from the Capital Market Authority (CMA) before it can file court proceedings, CMA said as it approved <a target=\"_blank\" href=\"https:\/\/tinyurl.com\/u63ts35r\" style=\"\" rel=\"noopener\">yesterday<\/a> the <a target=\"_blank\" href=\"https:\/\/ent.news\/2023\/12\/315.pdf\" style=\"\" rel=\"noopener\">amendments (pdf)<\/a> to regulations for companies operating in capital markets.<\/p>\n<p style=\"padding:0;margin:0;line-height:1.15;orphans:2;widows:2;text-align:left\"><strong>The essential rundown:<\/strong><\/p>\n<ul>\n<li><strong>The CMA can approve or reject bankruptcy requests <\/strong>from companies operating in capital markets if they hold client funds and \/ or assets or manage investment funds;<\/li>\n<li><strong>CMA has the authority to take any action<\/strong> its sees fit to protect clients;<\/li>\n<li><strong>Approval is required:<\/strong> Companies that hold investor funds or assets or are managing investment funds will have to get written approval from CMA ahead of filing for court protection in a bankruptcy or liquidation scenario;<\/li>\n<li><strong>Notification is enough for some companies: <\/strong>Companies that don\u2019t hold investor funds or assets and are\u2019t managing investment funds are only required to notify the authority 30 days ahead of starting their bankruptcy procedures in court.
