El Sisi is also due in Beijing later this month to attend China\u2019s Belt and Road Forum for International Cooperation, <a href=\"http:\/\/www.xinhuanet.com\/english\/2019-04\/05\/c_137952450.htm\">according to Xinhua<\/a>.<\/p><p><a class=\"content-anchor\" id=\"tldr-story-06\"><\/a> <b>The mood for the global economy this week is going to be set in Washington and in New York. <\/b>Specifically:<\/p><p><b>The IMF looks set to downgrade this week its global growth forecasts for 2019 and 2020<\/b> just in time for the aforementioned spring meetings of the IMF and World Bank. IMF boss Christine Lagarde reportedly still expects an \u201can anaemic pick-up later this year\u201d but \u201cbelieves that a major fiscal easing may be needed to reverse the downward trend in the longer term,\u201d according to the <a href=\"https:\/\/www.ft.com\/content\/23095e8e-5529-11e9-91f9-b6515a54c5b1\">Financial Times<\/a>. Lagard had said last week that <a href=\"https:\/\/www.reuters.com\/article\/us-imf-worldbank-lagarde\/imfs-lagarde-says-global-growth-outlook-precarious-amid-trade-tensions-idUSKCN1RE1DF\">the outlook is \u201cprecarious\u201d for an \u201cunsettled\u201d global economy<\/a> that is particularly vulnerable to trade wars, Brexit and financial markets shocks (including, say, a sell-off sparked by a run of poor earnings reports).<\/p><p><b>That comes as the global economy is entering a \u201csynchronised slowdown,\u201d<\/b> according to an index compiled by the Financial Times and US think tank Brookings that looks at \u201csentiment indicators and economic data\u201d across advanced and emerging economies.\u201d The Brookings-Financial Times TIGER (Tracking Indexes for the Global Economic Recovery) index shows that investment is easing across the world due to falling business and consumer confidence as well as geopolitical tensions, <a href=\"https:\/\/www.brookings.edu\/research\/april-2019-update-to-tiger-world-economy-lurches-from-uneven-recovery-to-synchronized-slowdown\/\">Brookings<\/a> writes. At the same time, record public debt levels mean that advanced economies are running low on ammunition to prevent a possible recession. The salmon-colored paper <a href=\"https:\/\/www.ft.com\/content\/d9bba980-5794-11e9-a3db-1fe89bedc16e\">has coverage here<\/a>.<\/p><p><b>So will poor 1Q earnings in Europe and the US be one of the triggers of Doomsday? <\/b>Maybe, the <a href=\"https:\/\/www.wsj.com\/articles\/corporate-profit-squeeze-looms-threatening-stocks-climb-11554634801\">Wall Street Journal<\/a> suggests, noting that \u201cdozens of companies have slashed their profit forecasts for the first quarter,\u201d from Walgreen Boots to FedEx, Apple and 3M. <a href=\"https:\/\/www.cnbc.com\/2019\/04\/05\/first-quarter-earnings-are-expected-to-be-lousy-but-stock-market-may-not-care.html\">CNBC is less certain<\/a>, acknowledging that (expected) poor first-quarter earnings could hit market sentiment, but fretting more about what could happen on Wednesday. That\u2019s when the US Federal Reserve releases the minutes of its last meeting \u2014 and when the EU meets to talk about Brexit.<\/p><p class=\"web-image\"><a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2019-04-07\/bonds-seen-as-last-man-standing-as-rally-loses-steam-em-survey?srnd=premium-middle-east\"><img data-recalc-dims=\"1\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/ent.news\/2019\/4\/3270.jpg?ssl=1\"><\/a><\/p><p><b>A ray of sunshine? Emerging market debt will continue to rally in the coming months <\/b>despite the fading recovery in developing economies, according to <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2019-04-07\/bonds-seen-as-last-man-standing-as-rally-loses-steam-em-survey?srnd=premium-middle-east\">Bloomberg\u2019s monthly EM survey<\/a>. \u201cWith the [US Federal Reserve\u2019s] dovish turn and risks of economic slowdown globally, central banks in emerging markets won\u2019t have to raise rates, which is a good environment for bond,\u201d FPG Securities CEO Koji Fukaya said.<\/p><p><b>In regional goings-on:<\/b><\/p><ul>\n<li><b>Saudi Aramco\u2019s upcoming USD 10 bn bond issuance is already 3x oversubscribed <\/b>as investors shrug off concerns related to the murder of journalist Jamal Khashoggi last year, <a href=\"https:\/\/www.ft.com\/content\/1b630cca-57c7-11e9-a3db-1fe89bedc16e\">the FT reports<\/a>.<\/li>\n<li><b>The US is pulling troops from Libya<\/b> as fighting between the east Libyan forces of Egypt-backed Gen. It\u2019s the best analysis we\u2019ve read to date on the legal nuances and implications of the case on future M&As and the ECA\u2019s ability to regulate them.<\/p>\n<p><b>How to use a spoon to cut a steak:<\/b> The Egyptian Competition Authority\u2019s guide to how to use anti-cartel legislative provisions to control and review mergers<\/p>\n<p><b>The decision:<\/b> On one fine morning, on October 23rd, 2018, the world woke up to the Egyptian Competition Authority (ECA) issuing a first of its kind decision that requires ride-hailing giants Uber and Careem obtain the pre-approval of the ECA before completing their \u201ccontemplated\u201d merger, which was brought to the attention of the ECA through media outlets. The decision looks at Uber and Careem as competing entities, and their contemplated merger a form of collusion that is penalized under Article 6 (a) and (d) of the Egyptian Competition Law No.3 for the year 2005 (the Antitrust Act) that governs the prevention of cartels. The decision itself was taken under Article 20, which entitles the ECA to intervene if they conclude from appearances and ostensible proof that a certain act, contemplated or committed, constitutes or would likely constitute a breach of the law with potential imminent and irreversible damages to consumers and\/or to competition itself.<\/p>\n<p><b>Egypt does not currently have a law that allows or empowers the ECA to review, approve or disapprove mergers whether prior to or following their completion<\/b>. Since the adoption of the Antitrust Act more than a decade and a half ago, the ECA has been fighting and lobbying in vein for a proper pre-merger control regime. The law itself was originally and primarily conceived and passed as a tool to fight monopolistic practices, such as a merchant or a group of merchants who restrict supply in order to raise their prices. To date, there is still no confirmed and serious indication that a comprehensive pre-merger control regime is on the government\u2019s legislative agenda.<\/p>\n<p><b>What the ECA has managed to obtain since 2005 through the current law (as a compromise of sorts) is the power to gather some \u201cpost completion\u201d information <\/b>about transactions of a certain size and this in order to keep themselves up-to-date and to study relevant markets when needed. So as things currently stand, Article 19 of the law requires mergers and acquisitions of a certain size be notified to the ECA within 30 days from the date on which the merger (or the acquisition) comes to effect. The threshold for notification is the cumulative turnover of EGP 100 mn . Failure to make the notification will result in a fine that ranges between EGP 20,000 and EGP 500,000. <b>It is therefore obvious that there is nothing in the act that would require the clearance or the pre-approval of the merger by the ECA.<\/b><\/p>\n<p>So when faced with the question of whether the law should prevent companies from merging or assess in advance the presumed harmful effect of a merger and take preventive measures,<b> the presumed answer by legislators has been so far: No<\/b>. Let them merge and the ECA will oversee what the resulting entity would do.
